Terms of Service

1 · Agreement
These terms are an agreement between you and GeminiBIM, the company behind TwinPoint ("we", "us"). By creating an account or using TwinPoint — including through a share link — you accept them. If you use TwinPoint on behalf of a company, you accept them for that company.
2 · The beta
TwinPoint is in beta. The service is provided as is: features will keep changing, and occasional bugs or interruptions are part of a beta. We work hard to keep your data safe and backed up, but we cannot guarantee uninterrupted service during this period.
Our beta promise: whatever you upload during the beta stays yours and stays online. At launch you will choose a plan; until then nothing is deleted, nothing stops being shareable, and you will not be charged.
TwinPoint is developed to support the SHARE3DCAM capture workflow and its export files. Uploads from other scanners or software in the same formats may work, but they are not verified or supported.
3 · Your account
During the beta, accounts are created by us for invited testers. Keep your password private — you are responsible for the activity under your account. If you believe someone else has gained access to it, tell us right away.
4 · Your content
Everything you upload — scans, photos, and related files — remains yours. You grant us only the limited permission needed to operate the service: to store your files, convert them to streaming formats, generate thumbnails and floor maps, run the automatic face blur, process scan alignment (which can include automated image comparison), and display your content to the people you choose through the share links you create and the members you invite. We never sell your content or use it for advertising.
Deleting a scan or project permanently deletes its stored files.
5 · People in your captures
To help, TwinPoint automatically blurs faces in 360 tour photos before they are stored, and provides a manual blur brush for anything the automatic pass misses. The automatic blur is a best-effort tool: it can miss a face, and using it does not shift your responsibility to us. Review your 360 photos before sharing, and use the brush where needed.
If we are notified that shared content violates someone's privacy, we may blur the imagery, disable the share link, or remove the content. Responsibility for claims arising from content you upload rests with you.
6 · Sharing
A share link can be opened by anyone who has it, unless you protect it with a password or an expiry date. Creating and sending a link is your decision and your responsibility, and you can revoke any link at any time from the Share dialog. Project members you invite can see the whole project, under the role you assign them.
7 · Acceptable use
- Upload only captures you had the right to make.
- Do not use TwinPoint for anything unlawful.
- Do not probe, overload, or disrupt the service, or attempt to access other users' data.
- Do not resell the service or present it as your own.
8 · Ownership of the service
The TwinPoint software, design, and brand belong to GeminiBIM. These terms give you the right to use the service; they do not transfer any ownership in it.
9 · Ending your use
You may stop using TwinPoint at any time and ask us to delete your account and data. We may suspend accounts that violate these terms; during the beta we will reach out to you first whenever practical.
10 · Disclaimers and limits
To the fullest extent permitted by law, TwinPoint is provided without warranties of any kind, and we are not liable for indirect or consequential damages, including lost data, lost profits, or lost business. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
11 · Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, United States.
12 · Changes to these terms
If we make material changes, we will email account holders before the changes take effect.
